Planning Conditions and Amendments
Conditions
Most permissions are granted subject to conditions. It is essential that these are complied with, as failure to comply could lead to formal enforcement action being taken.
Some conditions are known as "pre-commencement" conditions. These require the Council's written approval to certain matters (e.g. materials) before any development on the site starts. If you commence development without these matters being first agreed in writing, then the whole permission could be invalidated and all work carried out unauthorised. It is important that these conditions are all complied with before commencement starts and that you give the Council sufficient time in advance of work commencing, to clear any matters submitted for approval.
If you are unhappy with any conditions attached, then you can appeal against them to the Planning Inspectorate (www.planning-inspectorate.gov.uk) or submit a further application to vary or remove the condition or conditions.
Amendments to Planning Permissions
It is sometimes possible to deal with minor revisions to a planning permission without needing to submit a new application. To see if this is possible, you should write in to the Council with 3 copies of the amended drawings and state clearly what alterations are proposed. The case officer will then decide if it is possible to deal with it as a minor amendment. If not, then a new application will be required.
