Appeals against Planning Decisions
Applicants
If you have received a refusal of permission, or have obtained a permission, but it is subject to a condition that you do not agree with, then you can appeal against that decision. Appeals are made to the Planning Inspectorate. For further details and obtaining the appropriate forms, see their website www.planning-inspectorate.gov.uk
You must submit your appeal to the Planning Inspectorate within the set time limit for the type of development involved (usually 6 months from the date of decision or 2 months for advertisements). You should also send a copy to the Council at the same time.
It may be possible that a revised application would overcome the reasons for refusal without the need to go to appeal. A re-submitted application within a year of the refusal, by the same applicant, of no larger site area and of a similar character and description will not normally attract a planning fee. If you wish to see if this may overcome the original objections, you should first discuss this with the case officer.
Neighbours/Third Parties
There are no similar appeal rights for neighbours and third parties against planning decisions taken by the Council. The only challenge is a legal one through judicial review.
