Licence - sex shops

Local Government (Miscellaneous Provisions) Act 1982

Under legislation the local authority must grant licences to enable a sex shop/establishment to operate within the area.

Applications

Applications must be made to the Envronmental Health section together with the appropriate fee. In 2005/06 this is £1,300 for the first time application and £640 for annual renewal. A valid planning permission for the use of the premises as a sex establishment must be in existence.

The applicant must also carry out the following procedures:

  • within 7 days of making the application publish a notice in the local newspaper
  • within 7 days of making the application send a copy to the Chief Officer of Police
  • at the same time the application is made a notice informing the pubic must be displayed at the premises to be used.

Applications will be considered by the relevant Committee at the Council and a written confirmation of the decision will be sent to the applicant within 7 days.
