Change of Tenancy


 Joint tenancy

Tenants who want a husband / wife or partner, including same sex partners, to be included on the tenancy can apply for a joint tenancy.
Proof will be needed that the applicant has been living at the property continuously for the last 12 months. Acceptable proof would be gas / electrical bills or bank statements sent to the applicant at the address at least 12 months prior to the joint tenancy application.

In some circumstances, such as a relationship breakdown, we will agree to change a tenancy from two tenants to one. However, approval depends on personal circumstances and you should therefore seek further advice from a Housing Officer if you wish to apply to change your tenancy agreement in this way.


Taking over a tenancy


There are two types of circumstance where you can take over a tenancy from someone else - Succession and Assignment.
Succession

A Succession can take place when a tenant dies and a relative wants to live in the property and take over the tenancy. A spouse automatically succeeds a tenancy and does not have to be living at the property prior to the death.

A relative or partner of the deceased tenant can apply to succeed a tenancy in the event of a death, provided they can provide proof that they have been living at the property for at least 12 months immediately prior to the tenant's death. Acceptable proof would be gas / electricity bills or bank statements sent to the address at least 12 months prior to the application.


Assignment

In some circumstances, you have the right to transfer your tenancy to someone else by assignment, as long as you get our written permission first.


We will agree to this if:

  • a court has ordered you to give your tenancy to your husband, wife or cohabitant (person you live with as if you are married)
  • you are exercising your right to exchange
  • you want to assign your tenancy to someone who would have the right to succeed to it if you died

We can refuse to allow an assignment of your tenancy if it would be unreasonable; for example, if it would mean that your home would be under- or over-occupied
